These terms apply to your use of the Condex website at condex.ca, the documents you upload, and the reports we provide. By using the site or requesting a report, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the site.
When you upload documents, you confirm that:
You give Condex permission to store, copy and analyze the documents, and to use the building-level information drawn from them in the Condex database, our reports and our other products, as described in our Privacy Policy. This permission continues after your report is delivered.
Condex reports provide information and analytical context about a condominium corporation. They are not legal, financial, accounting, engineering, insurance or investment advice, and they do not replace your lawyer’s review of a status certificate or any inspection or professional advice.
A report is based on the documents provided and the information available to us when it is prepared. Documents can be incomplete, out of date or wrong, and our analysis may contain errors or omissions. Comparisons with similar buildings depend on the data we hold for those buildings. Grades, scores and statuses are our opinion of the information reviewed, not a guarantee of a building’s condition, finances or future costs. Check anything important before relying on it.
The Condex grading methodology is still being developed. Grades and scores are preliminary and may change as the methodology and the Condex database improve, including for a building that has already been graded. A grade is not a guarantee of a building’s condition, financial health or future costs. Reports supplement, and do not replace, professional due diligence.
We aim to deliver reports within one business day of receiving a complete upload. This is an estimate, not a guarantee.
The website, the reports and the Condex database belong to Condex and its licensors and are protected by copyright and other laws. Using them does not give you ownership of them.
Reports are delivered by email through a private link and password. Keep them private; anyone with both can open the report. Tell us promptly if you think they have been shared without your permission.
The website and reports are provided “as is” and “as available”, without warranties of any kind, to the extent the law allows. To the extent the law allows, Condex is not liable for any indirect, incidental or consequential loss, or for any loss arising from reliance on a report, and Condex’s total liability for any claim relating to the website or a report is limited to the amount you paid for that report, if any.
We may change the website, our reports or these terms, and we may suspend or stop any part of the service. The date at the top shows when these terms last changed. Continuing to use the site after a change means you accept the updated terms.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be heard in the courts of Ontario.
